Terms of Service

By creating an account or using Vyspra (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms form a legally binding agreement between you and Vyspra ("we", "our", "us"). By accepting these Terms, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement.

Vyspra is an AI-powered platform that enables parents and guardians to create personalized cinematic storybooks for children. The Service includes:

• Photo upload and AI-powered cartoon character creation
• AI-generated storylines and story text based on your child's character profile
• Scene illustration generation in multiple art styles
• Cinematic storybook production with voice narration and background music
• A shared family dashboard for multiple guardians linked to the same child

The Service is designed for parents and guardians creating stories for children. It is not intended for use by children under 13 without direct parental supervision and control.

• Registration — you must provide a valid email address and create a password. You are responsible for maintaining the confidentiality of your account credentials.
• One account per person — each email address may only be associated with one account. Creating multiple accounts to circumvent credit limits or other restrictions is prohibited.
• Account security — you are responsible for all activity that occurs under your account. Notify us immediately at hello@vyspra.com if you suspect unauthorized access.
• Accurate information — you agree to provide accurate registration information and to keep it current.

You agree not to use Vyspra to:

• Upload photos or create content involving real children without being their parent or legal guardian
• Generate content that is harmful, violent, sexually explicit, hateful, or inappropriate for children
• Attempt to circumvent our content safety systems or generate content that would violate the safety policies of our AI providers
• Impersonate another person, organization, or Vyspra itself
• Use the Service to scrape, harvest, or collect data about other users
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools (bots, scripts, crawlers) to access the Service without our written permission
• Resell or sublicense access to the Service
• Use the Service in any way that violates applicable laws or regulations

We reserve the right to terminate accounts that violate these acceptable use rules, with or without notice.

Ownership of content on Vyspra works as follows:

• Your uploaded photos — you retain all rights to photos you upload. By uploading, you grant us a limited license to process them solely for the purpose of generating your story content.
• AI-generated content (stories, illustrations, narration audio, cinematic storybook videos) — to the extent permissible by law, we assign to you a non-exclusive license to use, share, and display the generated content for personal, non-commercial purposes.
• Sharing generated videos — you may share generated videos with friends and family. You may not sell generated content, use it in commercial advertising, or claim authorship in a way that misrepresents the AI-generated nature of the content.
• Platform content — the Vyspra interface, branding, wordmark, and underlying software remain the intellectual property of Vyspra.

Vyspra offers the following paid plans:

• Free tier — 1 story credit granted on account creation at no charge.
• Starter pack — a one-time purchase of additional story credits via Stripe Checkout.
• Family subscription — a monthly recurring subscription providing a set number of story credits per billing cycle. Subscriptions renew automatically unless cancelled before the renewal date.

Credits: Story credits are consumed when a story generation pipeline is initiated. Credits are non-transferable and have no cash value.

Failed generations: If a story fails to generate due to a technical error on our end, any credits consumed will be automatically restored to your account. If the failure was caused by content that violated our acceptable use policy, credits will not be restored.

Refund policy: Purchased credits and subscription fees are generally non-refundable once consumed or after the billing period has started. We will consider refund requests made within 7 days of purchase if no credits have been used. Contact hello@vyspra.com for refund enquiries.

Subscription cancellation: You may cancel your subscription at any time via the billing portal. Cancellation takes effect at the end of the current billing period.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• AI-generated content will meet your specific expectations in terms of quality, style, or accuracy
• The Service will be available without interruption or error
• Generated stories will be entirely free from factual inaccuracies

To the maximum extent permitted by applicable law, Vyspra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount you paid to Vyspra in the 12 months preceding the claim.

Termination by you: You may delete your account at any time from the account settings page. Deletion is permanent and removes all your stored content, character profiles, and personal data (subject to our data retention obligations).

Termination by us: We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or our acceptable use policy. We will attempt to notify you before termination except where immediate action is required to protect other users or the integrity of the Service.

Effect of termination: Upon termination, your access to the Service ends immediately. Any remaining unused credits are forfeited. Active subscriptions will be cancelled at the end of the billing period.

We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision.

For material changes, we will notify you by email or via a prominent notice within the Service at least 14 days before the change takes effect. Your continued use of Vyspra after the effective date of the revised Terms constitutes your acceptance of those Terms.

If you do not agree to the revised Terms, you should stop using the Service and may delete your account.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vyspra is registered, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall first be attempted to be resolved amicably through direct communication. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of the relevant jurisdiction.
